Pocket Flier provides you with access to the Pocket Flier search engine and member area for the purposes of advertising one of more of your sites in Pocket Flier. By signing up as an advertiser, you unconditionally agree to all the following terms and conditions.

1. USE OF POCKET FLIER SERVICES
You may use the Pocket Flier website at your own risk. Pocket Flier is not responsible for loss or damage to you, your company and/or related parties.

Whenever a Consumer Clicks on an advertiser's listings, Pocket Flier will deduct an amount from the balance of advertiser's Prepaid Fund. The amount deducted will be equal to the amount of advertiser's bid for the search term that produced the advertiser's listing in the Consumer's search results. As the Prepaid Fund becomes depleted, it may be replenished by the advertiser from time to time by submission of a check or money order to Pocket Flier, or by charging the prepaid fees to an approved credit card. Advertiser's bids will not be processed, and advertiser's bids will not appear in search results on the Pocket Flier web page while the advertiser's account is depleted of funds. Pocket Flier will provide a continuously-updated list of Clicks charged to the advertiser's account, posted in the advertiser's member area. Advertisers are solely responsible for monitoring the balance of the prepaid fund, and for replenishing it before it becomes depleted. While Pocket Flier may elect, from time to time, to notify advertisers that the prepaid fund is nearing depletion, such notification is provided gratuitously, and is not an obligation of Pocket Flier.

2. PAYMENTS.
Payments must be received in advance. Sorry, Pocket Flier does not bill or offer Net Terms for any advertiser. Please note that any deposit is defined as the minimum amount required to open an account with Pocket Flier and is not refundable.

3. RIGHT OF LISTING REMOVAL
Pocket Flier reserves the right to reject or remove any search listing (also "web site advertising listing") at its discretion. You represent and warrant that all information, in the web site advertising listing itself or through the Web site to which the search listing links, does not violate any law or regulation; does not infringe in any manner any copyright, patent, trademark, trade secret or other intellectual property right of any third party; does not breach any duty toward or rights of any person or entity including, without limitation, rights of publicity or privacy, or has not otherwise resulted in any consumer fraud, product liability, tort, breach of contract, injury, damage or harm of any kind to any person or entity; is not false or misleading; and/or is neither defamatory, libelous, slanderous or threatening.

3a. ADULT SITES
A site may be categorized as an "adult" site if it presents sexual and/or erotic content, either graphically or verbally (including text and audio). Listings for these adult sites are limited to a set of search terms we consider clearly adult in nature. In addition, adult sites may not bid on non-adult search terms. Pocket Flier reserves the right to reject or remove any listings in contravention with the above. In the event of a removal or deletion, no refunds will be made on positive account balance.

4. RIGHTS AND RESPONSIBILITIES
It is your responsibility as a webmaster to maintain your web site advertising account information in a safe place. Pocket Flier is not responsible if others gain access to your web site advertising or Ambassador affiliate account, deplete your funds and/or change information in your account. It is your responsibility to maintain the integrity of your web site advertising account.

5. LIMITATIONS OF LIABILITY
Pocket Flier, its affiliates, associates, partners, parents companies, subsidiaries and/or employees shall not be directly or indirectly held liable for any damages or loss caused by the direct and/or indirect use of Pocket Flier, its services and/or content.

Under no circumstances shall Pocket Flier be liable for any damages or injury caused by, including but not limited to, any failure of performance, error, omission, interruption, defect, delays in operation of transmission, interruptions, computer virus, deletion of files or email, whether or not resulting from acts of God, communications failure, theft, destruction, or unauthorized access to Pocket Flier's records, programs, or services. Pocket Flier will not be liable for any damages or injury, including but not limited to, special or consequential damages that result from the use of, or the inability to use, the materials in this site.

6. AFFILIATE FUNDING
All funds credited to your Pocket Flier member account via our Ambassador affiliate program are considered final and not refundable in case of termination of service.

7. TERMINATION OF SERVICE
You may terminate your account at any time without refund.. Any balances remaining will cause your account to remain open. If your balance remains at $0.00 for a period of 60 days or more, Pocket Flier may delete your member account at its discretion.

8. SUBMISSIONS
All submissions are processed in real time, however may be removed by Pocket Flier in the event that Pocket Flier sees need to do so at its own discretion. See section 3. "Rights of Listing Removal".

9. DEPOSITS
All credit card deposits are processed via a secure connection to a US based credit card processor and you authorize Pocket Flier to submit your payment information for payment processing.

10. PRIVACY POLICY
We are committed to protecting your privacy. We use the information you provide for our mailing list and important communications regarding your account (Only if you are an advertiser and/or affiliate). We may also use your e-mail address to tell you about changes in our services or offers we think you will find valuable.

Whether you are placing bids, registering for our affiliate program or entering one of our sweepstakes, you always have the option to "opt-in" or "opt-out" of our email program.

Pocketflier.com does not store any of your credit card information on our site. We do not sell, trade or rent your personal information to others. We may choose to do so in the future with trustworthy third parties, but you can tell us not to.
